Recording: Maintaining Attorney-Client Privilege and Confidentiality in the Digital Age

As technological development moves seemingly at the speed of light, lawyers' ethical duties to zealously protect privilege and confidentiality are more complex than ever before. This course includes discussion on:
1) Maintaining client confidentiality with employees and agents, including discussion of attorney’s obligations to understand data and data transmission;
2) Maintaining security with opposing counsel communications, including watching metadata. Also, covering what happens with inadvertent disclosure, such as using private agreements and protective orders, and discussion of the federal rules provisions and select state provisions regarding the recipient attorney’s obligations.
3) Maintaining client security in the age of social media, including discussion on attorney responsibilities and obligations regarding use of social media as well as counseling clients on use of social media with regard to client confidentiality.
