December 14: Webcast - Using Contract Attorneys to Scale Your Law Practice #MCLE

In small law firms there is an inherent pickle when it comes to growth. If you hire employees too soon, there may not be enough work to go around. If you fail to build capacity, you lose profitable business that could have been yours. What to do?
An increasing number of law firms are solving this problem by outsourcing labor either temporarily or permanently. Outsourcing to contractors or specialty businesses instead of hiring employees can allow you to expand – that is, to “scale” – your practice. At the same time, this strategy allows you to mitigate the risk that comes with hiring employees or taking on additional tasks in house. Use of on-demand contractors means that they help is there when you need it, and costs you nothing when you don't.
Join us for a conversation to explore whether outsourcing could help you scale your law practice, increase profitability, and restore some much-needed work/life balance.

Each round of competition entails a time commitment of substantive work (training, listening to competition rounds, grading and delivering feedback) of approximately 3 to 3.5 hours. WBSA regulations restrict the number of CLE credits you may receive for judging moot court competitions to 6 CLE credits per three-year reporting period. Note that you will receive 3 credits if you judge one round, but 5.5 if you judge a round in both competitions. This is because pre-competition training counts for .5 credits, but it is identical for both competitions, and so cannot be counted twice.

November 17/Webcast: Determining the Value of One Patented Feature: A Behavioral Alternative to a Consumer Survey #MCLE

Recent Federal Circuit decisions have made it more difficult to prove damages in litigation. This is especially true when the infringed patent relates to just one feature in a product with multiple features. Before a patent owner can obtain damages based on the entire market value of a product (patented and unpatented components sold together), the patent owner may be required to prove that the patented feature is the basis for consumer demand for the entire product. Other decisions require the patent holder to apportion the value of the whole product down to the patented feature.
Whether a damages expert’s opinion can meet these requirements is a critical question for all patent litigants. Ultimately, the persuasiveness and reliability of the factual data on consumer demand for a patented feature underlying the damages case can determine the financial outcome of the case.
This webinar will cover these topics and more:

  • Relevant case law
  • Why proving consumer demand is key to receiving monetary damages
  • The shortcomings of typical survey approaches to measuring consumer demand
  • An alternative behavioral methodology for reliably measuring consumer demand

November 9: Web+Cleveland - #Election 2016: The Day After #MCLE

This panel discussion will review the 2016 election and what the results will mean for a politically divided nation. 435 house seats, 34 senate seats, and a new presidential administration- the 2016 election will determine the course of the country for years to come, where key issues including Supreme Court appointments, climate change, health care, immigration, abortion rights and national security will be determined by the new balance of our government.
A panel of CWRU Law Faculty will analyze the legal issues that were at the fore during the 2016 presidential campaign and forecast what matters a new administration will face. The program will especially benefit lawyers who address national policy matters in their practice but should be of interest to all lawyers and members of the community.

December 1: Web - Avoiding the "Inevitable": The Growing Consensus that Recidivism Can Best Be Averted through Early Attention to Eventual Re-entry and by Effective Alternatives to Incarceration

There is a growing consensus throughout many parts of the country that society should re-examine and replace many traditional modes of dealing with convicted adults and juveniles found to have violated the law. Increasingly, initiatives focus as early as possible following arrest on the person's eventual re-entry into society. Individualized assessments from the outset can enhance the ways in which the person's health care, education, housing, employment, and mental health needs are addressed during confinement – leading to those who are released being far more likely to be productive citizens and far less likely to commit more crimes. Moreover, a growing number of diversion programs, as an alternative to conviction and incarceration – and their juvenile law equivalents -- avert the often disastrous collateral consequences and enhance re-entry prospects. Such diversion programs include street-level crisis intervention, problem-solving courts, and immediate diversion to behavioral health services, substance abuse treatment, housing and employment community providers, or educational programs.

Please join Ronald J. Tabak from Skadden, Arps, Slate, Meagher & Flom LLP, who co-chaired the special committee that led the New York State Bar Association to adopt unanimously a report and recommendations on these issues. He will:
  • provide a national overview on how these issues are being addressed;
  • note some particular initiatives in New York; and
  • discuss how lawyers can work on re-entry as part of their overall pro bono work.

November 4: DC - Veterans Consortium Pro Bono Program Training #MCLE

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.
