Some cases seem leashed to the rails headed to trial. What common denominators make those cases so difficult to negotiate? How can advocates successfully negotiate roadblocks imposed by difficult clients or difficult lawyers, or by the negotiating parties’ undisclosed agendas, reluctance to share information, financial constraints, and strong emotions? When it’s not a question of “getting to yes,” but more an issue of “getting past no,” which strategies work for attorneys who want to blast through the stoppages?
